This project examined the justification and limitation of the so-called “cooperation agreement” in the Japanese criminal justice in comparison with the crown witness in the German criminal law. Two main results were found: (1) The cooperation with the prosecutor can reduce the general preventive needs against the collaborating perpetrator. It can justify sanctions below the minimum of statutory sentence in terms of the constitutional proportionality; (2) For the proper selection of collaborators, the prosecutor should consider the high probability of the conviction of the target person owing to the cooperation and the internal and contextual connection between the concerned acts by the collaborator and the target person.
